Introduction
This web site is operated by Create Canvass Limited ("CC"). The web site provides a number of services that may be used in accordance with these terms and conditions. The customer is defined as an individual or company who contracts with CC to purchase CC's products.
These terms govern the relationship between CC and the customer. By ordering products from CC the customer hereby agrees to abide by CC's terms and conditions. The website may only be used in accordance with the terms and conditions set out herein.
Only persons aged eighteen years or over may agree to these terms and use the website or the services offered through the website.
Terms and conditions may be subject to change. The customer should consult these terms and conditions each time they access the site.
Services
CC provides the following services through its website:-
- The production of canvas prints or other products which contain the customer's images which have been emailed, uploaded or posted to CC; and any related products including graphic walls, vinyls, exhibtion stands and graphic boards.
- the ability to order products which include CC's artwork from the website.
Images
Images received from the customer should be in JPEG (.jpg) format, other formats may be used, however in this instance, please contact CC directly.
Images uploaded by the customer or by CC on the customer's behalf, which are then turned into a personalized item will not be available for viewing to other users of this site.
Permitted Acts
The customer is soley permitted to use the website in accordance with the terms and conditions set out herein. The customer may access any part of the web site that is not password protected. Access to some parts of the site is only available if the customer has a valid password. The customer may not access these areas without a valid password. The customer may print off one copy per visit of any individual page or part of a page (other than the customer's own images) of the web site for the customer's own personal use. Provided that the customer is otherwise entitled to do so, the customer may print off as many copies of his own images as he may wish. In either case, the customer must not do any of the things set out under "Prohibited Acts", below.
Prohibited Acts
The customer may not at any time copy (whether by printing off onto paper, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or otherwise use any material contained in the web site except as set out under "Permitted Acts".
The customer must not:
- use the web site (or to copy or use any material from the web site) for any commercial purpose other than to conduct a commercial transaction with CC.
- remove any copyright, trade mark or any other intellectual property notices contained in the original material from any material copied or printed off from the website.
- upload, email to CC or order products of any images or other material which contain the following:
- pornographic or obscene material;
- racist material;
- material that is likely to incite hatred against any person or group;
- blasphemous material;
- defamatory or otherwise actionable material;
- images of any criminal act;
- material the use or inclusion of which infringes any copyright, trademark or other intellectual property right of any third party;
- material that breaches any applicable laws or legislation.
CC may, at its discretion, report any unlawful acts to the relevant authorities and provide details of any material emailed, uploaded or sent to CC, which comes under "Prohibited Acts," together with relevant personal information. This does not infringe the customer's rights under the Data Protection Act 1988.
Rights
CC confirms that the customer retains all intellectual property rights, including copyright, to the images that the customer sends or emails to CC.
The customer confirms that he holds the rights to any image used by the customer in any products created by CC. In accordance with this section the customer aggress to provide the indemnity more specifically set out below.
CC or CC's artists retains all copyright in the images its provides for sale from CC's website.
Indemnity
The customer agrees to indemnify CC, its officers and employees against any action, claim, damages, liability, costs and expenses arising out of the following:
- any use by the customer or the customer's guests of this web site in breach of these terms, any claim that the use of any images by the customer or on the customer's behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights; and
- any claim that the processing, printing or other dealing with by CC in accordance with these terms of any images emailed or sent by the customer or on the customer's behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights.
Reserved Rights
CC reserves the right to:
- change the format and content of the web site (or any products or services offered by this web site) at any time;
- terminate or suspend the operation of its web site (or terminate or suspend provision of any products or services offered via this web site) for support or maintenance work, in order to update the content or for any other reason, at any time and without notice; and
- display, modify, print, transmit, distribute or delete any of the images that the customer uploads, emails or posts to CC, provided that this use is necessary in order to provide any of the products offered by CC via the website or is otherwise allowed by these terms.
CC's Products
Once the customer has placed an order for any goods via its website, the order will not be treated as having been accepted until the customer receives a confirmation email from CC. This confirmation may be by email or post.
The decision as to whether to accept any order from the customer is at CC's discretion and CC is not bound to do so.
To maintain continuity of service CC reserves the right to use alternative materials in production, to those stated on the website.
Offer codes may be published from time to time as part of a promotion. Offer codes may provide a free item or a discount on part of an order. Offer codes can only be used for online orders placed through this web site. A maximum of one offer code can be specified per order. Unless otherwise specified, postage and packing charges will still apply to orders subject to an offer code. Further conditions may apply and if so will be published with the relevant offer code.
CC will use its reasonable endeavours to reply promptly to all correspondence. Such reply may be by email or by post.
Termination
CC may terminate an order without notice and at CC's sole discretion.
In the event that an order is terminated, the images will be removed from CC's systems and any monies due will be refunded in such circumstances.
Questions or complaints
Complaints or claims must be notified to CC within fourteen days of receipt of goods, or in the case of non-delivery, in a reasonable time after the goods were expected to arrive. Advisory
The customer is advised to keep back ups of all material provided to CC. In particular, it is the customer's responsibility to keep backup copies of images sent, uploaded or emailed to CC. CC will not be responsible for keeping backups or for loss of, deletion or corruption of any images or any other material.
Law and Jurisdiction
These terms and conditions (and the provision of goods by CC) are governed by and are to be interpreted in accordance with English law. In the event of any dispute arising in relation of these terms or in relation to the provision of any goods from CC, the English courts will have exclusive jurisdiction over such a dispute.
Returns Policy
If a product is faulty in any way, the customer may return it to CC within 14 days. Please call CC's Customer Services Department on 0871 8393939 upon receipt of the product quoting the order number.
The customer must not return products to CC without contacting a member of the Customer Services Team first.
To return faulty goods the customer must firstly contact a member of our Customer Services on 0871 8393939.
CC will only acknowledge returned goods if they are sent using Royal Mail 'Signed For' Recorded delivery with proof of delivery. The customer must meet the delivery costs of returning any faulty products.
It is only when CC receives the item in its original state that CC will redo or recommend remedy for a faulty item. Please note if the product is not in an unused condition then CC will not be able to offer the customer a remedy save for faulty workmanship, which CC may repair.
Where there is minor fault CC may suggest an alternative remedy.
Credit Card Payments
CC uses HSBC Payment Services to process all credit/debit card transaction for CC. Customers using CC's checkout methods then will be directed to HSBC's sites for card authorisation. Upon completion CC will send the Customer an email to confirm the purchase.
